Sinapsys Ubiquitous Computing SL (hereinafter “Sinapsys”) is the owner of the LiverColor and KidenyColor apps, under visionemlabs.com (hereinafter the 'VisionemLabs') and is responsible for the processing of personal data of its users (hereinafter the 'Users'). Through this Privacy Policy, and in compliance with Articles 12 and 13 of Regulation (EU) 2016/679 (hereinafter 'GDPR') and Article 11 of the Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights ('LOPDPGDD'), Sinapsys informs Users using the LiverColor app about the processing of their personal data that may be collected through this and processed by Sinapsys.

To which recipients will your data be communicated?

Sinapsys informs that, for the fulfillment of the purposes described above, it will not transfer the User's personal data to third parties. Notwithstanding the foregoing, Sinapsys may give access to such personal data to:

• Technology service providers with which it has entered into a processor contract; in particular to:
  • Database maintenance and newsletter subscription management service providers.
  • Analytical service providers.
  • Hosting service providers.
  • E-mail service providers.
  • Consent Management Platform Providers (Consent Management Platform)
  • Payment gateway providers

The aforementioned providers may be located in jurisdictions that generally do not provide adequate safeguards in relation to the processing of personal data. For all entities that are not part of the European Economic Area (EEA), Sinapsys has entered into contracts with such entities that include such safeguards, including the European Commission's model clauses.

Users may obtain more information about technology service providers by requesting the same from Sinapsys through the means of contact provided in this privacy policy.

Also, Sinapsys may communicate your data to:

• Other companies that are part of the Sinapsys.
• Companies interested in buying or acquiring the company or a part of its business and, consequently, give access to any national or international auditor to carry out their due diligence.
• Authorities to investigate suspected fraud, harassment or other violations of any law, rule or regulation, or of the app policies.

Sinapsys undertakes to adopt the necessary technical and organizational measures, in accordance with the provisions of the applicable regulations, to ensure the security of personal data and prevent the accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, or unauthorized communication or access to such data. Personal data will be treated confidentially by Sinapsys, which undertakes to inform and enforce, by legal or contractual obligation, such confidentiality to its employees, partners and any person who should have access to the User's personal data.

User Rights

The User may exercise the rights of access, rectification, deletion, opposition and, where appropriate, limitation of processing and portability of data by sending an email to support@visionemlabs.com Likewise, the User may file a complaint with a supervisory authority and, in particular, with the Spanish Data Protection Agency (www.aepd.es) if he/she considers that the rights set forth above in this Privacy Policy have been violated or if he/she considers that the processing of personal data concerning him/her violates the applicable regulations.

Changes in the Privacy Policy

Sinapsys reserves the right to modify this Privacy Policy at any time. Changes or updates to the Privacy Policy will be explicitly notified to the User by means of a notice on the App, together with the updated version of the Privacy Policy.

Purpose of personal data processing:

For what purpose will we process your personal data?

To proceed with the registration, access, and subsequent use of VisionemLabs, the User must provide - on a voluntary basis - personal data (primarily identification and contact information), which will be incorporated into automated systems owned by Sinapsys.
The collection, storage, modification, structuring, and, where appropriate, deletion of the data provided by the Users will constitute processing operations carried out by the Controller, with the purpose of ensuring the proper functioning of VisionemLabs, maintaining the service and/or commercial relationship with the User, and for the management, administration, information, provision, and improvement of the service.
The personal data provided by the User - especially the email address - may also be used to send newsletters, as well as commercial communications about promotions and/or advertising of VisionemLabs, provided that the User has previously given explicit consent to receive these communications electronically.

For how long are the personal data collected kept?

The personal data provided will be retained for the duration of the commercial relationship or until a deletion request is made by the individual. Additionally, the data will be kept for the period necessary to fulfill any legal obligations associated with the services rendered.

Legitimization:

The processing of the User's data is carried out based on the following legal grounds that legitimize it:

• The request for information and/or contracting of services from VisionemLabs, the terms and conditions of which will be made available to the User in advance for their express acceptance.
• The User's free, specific, informed, and unambiguous consent, with this privacy policy being made available to them, which they must accept through a statement or a clear affirmative action, such as checking a box provided for this purpose.

If the User does not provide their data to Sinapsys, or does so incorrectly or incompletely, it will not be possible to proceed with the use of VisionemLabs.

Commercial communications

In application of the LSSI. Sinapsys will not send advertising or promotional communications by email or other equivalent electronic means of communication that had not previously been requested or expressly authorized by the addressees thereof. In the case of users with whom there is a prior contractual relationship, Sinapsys is authorized to send commercial communications regarding products or services of Sinapsys that are similar to those initially were contracted with the client. In any case, the user, after proving its identity, may request that it not be send you more commercial information through the channels of Customer Service.
